The bill (Reg.No.10618) aims at ensuring clarity and transparency of the process of judicial selection, normative clarity of its mechanisms, providing equal opportunities for access to the position of professional judge by amending articles 70, 73 and 80 of the Law "On Judicial System and the Status of Judges".
It is suggested to supplement articles 73 and 80 with several suggestions to clearly define the order of transferring the judge to another court within the five year period and the order of transfer of a judge, elected without term limitation to another court.
Article 70 of the Law "On Court System and the Status of Judges" determines the procedure of passing qualification exam for persons with special training willing to be recommended to the post of a judge.
Despite the fact that the article refers determination of personal and moral qualities of a candidate to components of the qualification exam, it does not contain the procedure for their determination. Members of the Committee stressed that the existing mechanism of holding the qualification exam proves that it can only determine professional qualification of a candidate.
Members of the Committee stressed that limitation of check of theoretical and practical knowledge by jurisdiction of a certain court formally narrows the possibility of candidates to participate in competitions for vacancies at courts of different jurisdictions.
